This website is operated by Spann Fitness (“we”, “us”, or “our”). Throughout the site, the terms “we”, “us” and “our” refer to Spann Fitness. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. Please read these Terms carefully before accessing or using our website.

2. Eligibility

You must be at least 18 years old, or the legal age of majority in your jurisdiction, to purchase from this site. By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence.

3. Products & Pricing

All products are subject to availability. Prices are in U.S. dollars and are subject to change without notice. We reserve the right to refuse any order placed with us. We reserve the right to limit quantities purchased per person, per household, or per order.

We have made every effort to display the colors, dimensions, weights, and features of our products as accurately as possible. We cannot guarantee that your computer monitor's display will be 100% accurate.

4. Intellectual Property & Patent

The Spann Bar is protected by U.S. Patent No. D 1,105,306. All content on this website — including but not limited to text, graphics, logos, images, product names, and the “Spann Bar” and “Spann Fitness” marks — is the property of Spann Fitness or its content suppliers and is protected by United States and international copyright and trademark law.

You may not reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of the website or product designs without express written permission from us.

5. Use of the Product

The Spann Bar is a piece of fitness equipment intended for use by athletes, coaches, and trained individuals. By purchasing and using the Spann Bar, you acknowledge that:

  • Strength training and landmine training carry inherent risk of injury.
  • You assume all responsibility and risk associated with use of the product.
  • You will follow proper form and consult a qualified coach, trainer, or medical professional before beginning a new training program.
  • The Spann Bar must be used only with a properly installed landmine attachment and standard Olympic weight plates within its rated load capacity (550 lbs).

6. Orders, Payment & Cancellation

By placing an order, you agree that all order information you provide is accurate and complete. We reserve the right to cancel or refuse any order at our discretion, including orders that appear fraudulent, are placed at incorrect prices due to typographical error, or violate these Terms.

Order modifications or cancellations may be requested by emailing collis@spannfitness.com within 2 hours of order placement. Once an order has shipped, it cannot be cancelled and must be processed as a return per our Refund Policy.

8. Warranty & Disclaimer

Every Spann Bar is covered by a 1-year limited warranty against manufacturing defects from the date of delivery. The warranty does not cover damage caused by misuse, abuse, accidents, exceeding load capacity, improper storage, or normal wear and tear.

EXCEPT FOR THE EXPRESS LIMITED WARRANTY ABOVE, THE PRODUCTS ARE PROVIDED “AS IS” AND WITHOUT ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

9. Limitation of Liability

To the maximum extent permitted by law, Spann Fitness shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with your use of the website or the Spann Bar product, even if advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless Spann Fitness, its officers, owners, employees, and agents from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey.

12. Changes to These Terms

We reserve the right to update, change, or replace any part of these Terms by posting updates to this page. It is your responsibility to check this page periodically. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.
